Welcome to SnapYummy. These Terms of Service ("Terms") govern your use of the SnapYummy mobile application and website (the "Service"), operated by SnapYummy ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use SnapYummy. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.
3. User Content
Ownership: You retain ownership of the photos, videos, captions, and other content you post ("User Content").
License to us: By posting User Content, you grant SnapYummy a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content within the Service, solely for the purpose of operating and promoting SnapYummy.
Your responsibility: You are solely responsible for your User Content. You represent that you own or have the necessary rights to post it, and that it does not violate any law or infringe any third party's rights.
4. Acceptable Use
You agree not to:
- Post content that is illegal, harassing, hateful, sexually explicit, or violent
- Impersonate any person or entity
- Post content you do not have the rights to share, including copyrighted videos or images belonging to others
- Attempt to access another user's account or our systems without authorization
- Use the Service to spam, scrape, or harvest data without our permission
- Interfere with the proper functioning of the Service
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
5. Reporting and Moderation
If you encounter content or behavior that violates these Terms, you can report it directly in the app. We review reports and may remove content, warn, suspend, or ban accounts at our discretion.
6. Restaurant Business Accounts
If you register a business account on behalf of a restaurant, you represent that you are authorized to act on that restaurant's behalf. Business accounts are subject to additional terms, including:
- Free trial and billing: Certain business features may be offered with an initial free trial period, after which a paid subscription begins automatically unless canceled before the trial ends. You authorize us (via our payment processor) to charge your provided payment method according to the plan you select.
- Content accuracy: You are responsible for the accuracy of your restaurant's profile, menu, hours, and promotional content.
- Promotions and perks: Any perks, discounts, or promotions you offer through SnapYummy are your responsibility to honor. SnapYummy is not liable for a business's failure to honor an offered promotion.
7. Points, Rewards, and Perks
Points earned within the Service have no cash value and cannot be transferred, sold, or redeemed for cash. We reserve the right to modify, suspend, or discontinue the points/rewards program, or adjust point values and redemption options, at any time.
8. Termination
You may delete your account at any time through Settings. We may suspend or terminate your account if you violate these Terms, at our reasonable discretion, with or without notice.
9. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy of restaurant information, menus, hours, or promotions, which may change without notice. Always confirm details directly with the restaurant.
10. Limitation of Liability
To the maximum extent permitted by law, SnapYummy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
